A comprehensive overview of South Carolina Workers’ Compensation System which includes compensability determinations, disability, and medical benefits provided by the Act and defenses to claims. You will also cover information about the make up of the South Carolina Workers’ Compensation Commission, the practical aspects of handling claims and certain key forms that are required by the South Carolina Workers’ Compensation Commission.
Legal Module 1: The South Carolina Workers Compensation Legal System:
This module provides an overview of the South Carolina Workers’ Compensation Act including what constitutes a compensable injury, repetitive motion injuries, stress claims and occupational disease claims.
Legal Module 2: Benefits under the South Carolina Workers’ Compensation Act:
In this module, you will learn about medical benefits, compensation, temporary compensation benefits, and permanent partial disability benefits under the South Carolina Workers’ Compensation Act. This module will also cover how to determine the average weekly wage and compensation rate in South Carolina and how permanent partial disability benefits are awarded in South Carolina.
Legal Module 3 : Practical Aspects of Claims Handling:
In this module, you will learn when temporary total benefits must be started and how and when temporary total benefits can be suspended or terminated. An explanation of how claims can be closed or settled will also be provided in this module. Finally, this module will cover how informal conferences, hearings, and appeals are handled in the South Carolina Workers’ Compensation System.
Legal Module 4: Defenses to South Carolina Workers’ Compensation Claims:
In this module, you will learn about defenses that can be utilized when denying a workers’ compensation claim in South Carolina. The defenses discussed will include the intoxication defense, the going and coming defense, the statute of limitations defense, misrepresentation in the application for employment defense, and the notice defense.

This live or recorded Webinar provides up-to-the-minute information on new South Carolina court cases, South Carolina administrative decisions and legislative changes.
Exam:
One exam is included in the South Carolina Worker's Compensation Series. It consists of 50 questions with a 90 minute time period.
You will have one attempt to pass this exam. The pass mark is 70%.
About the Author
Your instructor is Hal Willson, a shareholder with the firm of Willson Jones Carter & Baxley, P.A., in Greenville, South Carolina. Hal received his B.A. degree, cum laude, from Wofford College and his J.D. degree from the University of South Carolina School of Law. He was a member of the Environmental Law Journal at University of South Carolina School of Law.
